Foxy Home Buyer Commitment Guarantee

Terms & Conditions

This Commitment Guarantee (“Guarantee”) is offered by Foxy Home Buyer (“Company”) to eligible home sellers who engage our services to sell their residential property.

1. Purpose

The purpose of this Guarantee is to provide sellers with additional peace of mind by offering a one-time compensation of up to $2,500 if Foxy Home Buyer is unable to facilitate the sale of the property under the agreed-upon terms and marketing process.

2. Eligibility Requirements

To qualify for compensation under this Guarantee, the following conditions must be met:

  • Seller has signed a listing agreement, direct sale agreement, or marketing agreement with Foxy Home Buyer.

  • Seller has cooperated in all efforts to prepare, show, and market the home as advised by Foxy Home Buyer.

  • The property has been available for sale for at least 90 consecutive days under the Foxy Home Buyer process.

  • Foxy Home Buyer has had full and continued access to market the property during the agreed-upon listing period.

  • The seller has not withdrawn, canceled, or materially changed the terms of the sale (such as price, availability, or property condition) without mutual agreement.

  • No offers at or above the recommended price (or an offer reasonably close thereto) were declined without mutual agreement by both seller(s) and Foxy Home Buyer.

3. Exclusions

This Guarantee does not apply under the following circumstances:

  • Seller chooses not to follow recommendations regarding pricing, repairs, or staging.

  • Seller receives and declines reasonable offers.

  • Significant changes in the property’s condition that impact marketability.

  • Market disruptions or force majeure events (e.g., natural disasters, legal disputes, tenant occupancy issues, etc.).

  • Seller voluntarily terminates the agreement or ceases communication.

4. Compensation Details

  • The maximum compensation available under this Guarantee is $2,500.

  • Any compensation amount is determined solely by Foxy Home Buyer based on a good-faith review of the listing history and marketing efforts.

  • Compensation will be issued within 30 days of determination and will be in the form of a check or electronic payment.

5. Dispute Resolution

Any disputes related to this Guarantee will be resolved through informal negotiation. If unresolved, the parties agree to submit to mediation before seeking legal remedies.

6. Changes and Termination

Foxy Home Buyer reserves the right to modify or terminate this Guarantee at any time. However, any changes will not affect agreements already in progress under a signed listing or marketing contract.
